Terms of Agreement

Review Garden helps businesses solicit customer feedback. Customers may be directed to leave a public review (for example on Google) or submit private feedback to the business. You are responsible for how you use the Service with your customers, including postcard, email, and other outreach.

You must provide accurate account information and keep your login credentials secure. You are responsible for activity under your account. You must be able to form a binding contract to use the Service. If you use Review Garden on behalf of a business, you represent that you have authority to bind that business to these Terms.

You retain ownership of content you upload (such as logos, background images, and business details). You grant Review Garden a limited license to host, display, and process that content solely to operate the Service.

Private feedback submitted through your landing pages is provided for your business. You are responsible for responding to that feedback lawfully and appropriately. Review Garden does not post private feedback as public reviews.

You agree not to:

• Use the Service to send spam, deceptive messaging, or unlawful solicitations
• Misrepresent your business identity or review practices
• Attempt to coerce, incentivize, or filter reviews in ways that violate Google or other platform policies
• Probe, disrupt, or reverse engineer the Service except as allowed by law
• Upload malware or content you do not have rights to use

The Service may integrate with third parties such as Google (for review destinations), Firebase (for authentication and data storage), and email providers. Your use of those services is also subject to their terms and policies. Review Garden is not responsible for third-party platforms, including how Google displays or moderates reviews.

We may update, suspend, or discontinue features of the Service. We may also revise these Terms. Continued use after changes become effective constitutes acceptance of the updated Terms. Material changes will be reflected by updating the "Last updated" date on this page.

The Service is provided "as is" and "as available." To the fullest extent permitted by law, Review Garden disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee a specific volume of reviews, ranking outcomes, or that every customer will complete a review or private feedback submission.

To the fullest extent permitted by law, Review Garden and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amounts you paid us for the Service in the twelve months before the claim or (b) one hundred U.S. dollars ($100), if you have not paid us.

You agree to defend and indemnify Review Garden and its operators against claims arising from your use of the Service, your content, your customer outreach, or your violation of these Terms or applicable law.

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if needed to protect the Service or other users. Provisions that by their nature should survive termination (including ownership, disclaimers, and liability limits) will survive.

These Terms are governed by the laws of the State of California, excluding conflict-of-law rules. Courts located in California will have exclusive jurisdiction over disputes arising from these Terms, except where prohibited by applicable law.
